These Terms and Conditions ("Terms") govern your access to and use of the website located at innovativefoundationrepair.com (the "Site"), operated by Innovative Foundation Repair ("Company," "we," "us," or "our"). By accessing or using the Site, submitting a quote request, participating in our referral program, or otherwise interacting with the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

By using the Site in any manner, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced in them, including our Privacy Policy and Cookie Policy. We may update these Terms from time to time as described in the "Changes to These Terms" section below. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. Services Described

Innovative Foundation Repair provides residential and commercial foundation repair and related services, including slab foundation repair, pier and beam foundation repair, drainage solutions, and root barrier installation, across our service areas in North Texas, San Antonio, and Waco, Texas. The Site is provided for informational purposes and to allow prospective customers to request free inspections and quotes. Nothing on the Site constitutes a binding offer to perform services; all work is subject to an in-person inspection and a separate written estimate or contract between you and the Company before any repair work begins. Prices, availability, promotions, and warranty terms described on the Site are subject to change and to confirmation at the time of your inspection.

3. Use of the Website

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • Submit false, misleading, or fraudulent information through any form on the Site, including the quote request or referral forms;
  • Use the Site in any way that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site;
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or any systems or networks connected to the Site;
  • Use any automated system, including "robots," "spiders," or offline readers, to access the Site in a manner that sends more request messages than a human could reasonably produce;
  • Use the Site to transmit any virus, malware, or other harmful code;
  • Copy, reproduce, or republish substantial portions of the Site's content without our prior written permission.

All content on the Site, including text, graphics, logos, images, and diagrams, is the property of the Company or its licensors and is protected by applicable intellectual property laws. You may view and print pages from the Site for your own personal, non-commercial use, provided you keep all copyright and other proprietary notices intact.

4. Quote and Lead Submissions

When you request a free inspection or quote through the Site, we ask you to provide your name, email address, phone number, ZIP code, the service you are interested in, and any additional message or details you choose to share. By submitting this information, you:

  • Represent that the information you provide is accurate and that you have the authority to request service at the property described;
  • Consent to be contacted by the Company by phone, text message, and/or email regarding your request, using the contact information you provided;
  • Understand that submitting a quote request does not create a contract for services — a contract is formed only when you and the Company separately agree to a written estimate or work order.

We handle information collected through the quote form in accordance with our Privacy Policy. Submitting the form does not guarantee a specific price, timeline, or scope of work; final terms are determined after an on-site inspection.

5. Referral Program Terms

The Company offers a referral program under which an existing customer or Site visitor ("Referrer") may refer a friend, family member, or neighbor ("Referred Party") to the Company for foundation repair or related services.

  • A $100 gift card is issued to the Referrer only after the Referred Party becomes a new customer of the Company — meaning the Referred Party has scheduled and completed a paid service with the Company. Merely submitting a referral, scheduling a free inspection, or receiving a quote does not qualify the Referrer for a gift card.
  • Referrals must be for individuals who are not existing customers of the Company at the time of referral.
  • The Company reserves the right to verify that the Referred Party's service was completed and paid for before issuing a gift card, and to determine, in its reasonable discretion, whether a referral qualifies under this program.
  • Gift cards are issued once per qualifying Referred Party and are not redeemable for cash. There is no limit on the number of qualifying referrals a single Referrer may submit.
  • The Company may modify, suspend, or discontinue the referral program, or change these referral terms, at any time and without prior notice, though such changes will not affect gift cards already earned for referrals that qualified before the change.
  • The referral program is offered as a courtesy and does not constitute a guarantee of payment for any referral that does not result in a completed, paid service.

6. Financing Disclaimer

The Company offers customers the option to apply for financing through Hearth, an independent, third-party financing platform, to help make payment for services more manageable. Hearth is not owned or operated by the Company, and any financing application, approval, terms, rates, and fees are determined solely by Hearth and/or its third-party lending partners in accordance with their own eligibility criteria, terms of service, and privacy policy.

Referring you to Hearth, or providing a link to Hearth's application, does not constitute a guarantee of financing approval, and the Company makes no representation or warranty regarding whether you will be approved, the terms you may be offered, or your experience using Hearth's platform. Any financing agreement you enter into is strictly between you and Hearth (or its lending partner), and the Company is not a party to, and bears no responsibility or liability for, that agreement. Please review Hearth's own terms and conditions carefully before applying.

7. Warranty Reference

The Company offers warranty protection on qualifying foundation repair work, with specific coverage terms depending on the service performed. Full, current warranty details are described on our Warranties & Financing page and will also be confirmed in writing as part of your service agreement. These Terms do not restate specific warranty coverage, durations, or conditions; please refer to the Warranties & Financing page for that information, and contact us with any questions before or after your service is performed.

8. Limitation of Liability

The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by applicable law, the Company, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. Nothing in these Terms is intended to limit any warranty or liability related to foundation repair services actually performed under a separate written service agreement; this limitation applies specifically to use of the Site itself.

9. Governing Law

These Terms, and any dispute arising out of or relating to the Site or these Terms, shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

10. Changes to These Terms

We may revise these Terms from time to time to reflect changes to our services, the Site, or applicable law. When we make changes, we will update the "Last updated" date at the top of this page. We encourage you to review these Terms periodically. Your continued use of the Site after any changes are posted constitutes your acceptance of the updated Terms.
